Abstract

The hospital is not merely a kind of place in medical practice but it has legal position as legal subject. In case legal subject, the hospital must be constructed by legal entity on corporation. As corporation, the hospital has unique characterizing than the others. It is affected by the corporate organ structure that forms legal entity. The positioning of organ structure classify in governing body-trustee, CEO-staff, medical staff. Therefore, vicarious liability as provided on article 46 statute number 44/2009 must be applied properly. The application of law should consider a corporation characteristic and the nature of medical transaction. In adjudication of law, a court condemn to legal entity and legal person on negligence cases relating with a damage. On the other hand, construction of defendant on corporation legal sue arise a kind of circumstances. This research focus to formulate about hospital legal standing and liability as legal entity on medical services.
