A Comparison of Law Enforcement in Cross-Island Flow in Indonesia and the Philippines

In every country, especially for an archipelagic and coastal states, is given the authority and rights to manage its territory including the sea, the air above it and the natural resources contained therein. The authority and rights of an archipelagic state are regulated in article 46 UNCLOS which explains the terms of an archipelago state. In the international maritime law, every country submits to UNCLOS year 1982. Article49 paragraph 4 says that the law of the sea is subject to the archipelagic sea lane regime which has been regulated in the UNCLOS year 1982. Archipelagic sea lanes passage is a right which passes through archipelagic waters. At first glance, archipelagic sea lanes passage looks the same as the transit passage, but the transit passage pass through the strait, while the archipelagic sea lanes passage pass through the archipelagic waters. The rights of an archipelagic sea lanes passage of the sea in UNCLOS 1982 are regulated in article 53, which explains the rights of an archipelagic sea lanes passage such as; ships and planes crossing an archipelagic water with continuously, prohibition of deviating 25 miles from the axis lines of both ships and planes, the right to enjoy archipelagic sea lanes passage and others provision stipulated in articles 53 UNCLOS year 1982. Indonesia and the Philippines were the pioneers of the archipelagic and coastal state regimes in UNCLOS year 1982.
